DISTILLERY/BREWERY/WINERY
TOUR AND SPECIAL EVENT
RESERVATION AGREEMENT
This Distillery/Brewery/Winery Tour and Special Event Reservation Agreement (“Tour Reservation Agreement) is between the user referred to herein as “Customer,” and KENTUCKY BARREL BUS, INC, a corporation, organized and existing under the laws of the State of Kentucky, with its principal office located at 3085 W River Road, Taylorsville, KY 40071 referred to herein as “KBB.” Collectively, KBB and Customer shall be referred to herein as the “parties.”
Whereas, KBB owns and operates a distillery, brewery, and winery touring and special event chartering business out of its Taylorsville office; and Whereas, Customer desires to participate in a distillery/brewery/winery tour or rent KBB bus for for a special event and attests that he/she is 21 years of age or older.
Now, therefore, for and in consideration of the mutual covenants contained in this Tour Reservation and Agreement and other good and valuable consideration the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows:
1. THE ACTIVITY
Customer will either rent KBB bus for a special event or participate in a winery/ distillery/ brewery bus tour organized and conducted by KBB which shall consist of visits to various facilities. In the case of organized tours by KBB, hereinafter referred to as the TOUR, Customer may tour the facility upon availability of the individual brewery/winery/distillery. Customer will receive tastings of various beverages. The amount of tastings will vary depending on the specific ticket purchased. In the case of hiring KBB to use the bus for a special event, KBB will provide services set forth and agreed upon via communication with Customer.
2. PAYMENT TERMS
In consideration for Customer participating in and KBB reserving a space for Customer on the above described TOUR, Customer shall pay to KBB price as listed on tour ticket or price for special event as agreed to between Customer and KBB.
3. BOOKING FOR PRIVATE EVENTS
All private events must be paid in full at the time of reservation. See below for cancellation policy. If the event exceeds the agreed time frame, Customer will be charged an additional hourly rate of $375 for every hour that your event exceeds.
4. SERVICES
KBB shall devote as much productive time, energy and abilities as is needed and necessary to provide the TOUR as described in this Tour Reservation and Agreement. Customer understands and agrees that up to 21 additional participants will be on the TOUR.
5. CUSTOMER BEHAVIOR
Customer agrees to comply with the Rules for TOUR Participation, see below. Customer agrees to behave in such a manner so as not to disrupt the enjoyment of other participants taking part in the TOUR. Any violation of the Rules for TOUR Participation or other disruptive behavior by Customer may result in Customer being expelled from the TOUR without refund of any payments that have been made to KBB by Customer. Any damages and/or breakages caused by Customer whether accidental or deliberate will be charged to the Customer and must be paid for before the TOUR has been completed.
Please see detailed list of “Rules for TOUR Participation” more fully set forth below. In addition, further rules set forth by each individual establishment on the TOUR must be abided by.
6. ASSUMPTION OF RISK
Customer acknowledges that he/she will be engaged in traveling by bus from one facility to another and will be touring certain brewery, distillery, and/or winery operations. Customer acknowledges that he/she may during these activities consume alcohol. Customer acknowledges the inherent risks associated with traveling by bus, touring a manufacturing facility and consuming alcohol. Customer fully accepts those risks. These risks may include, but are not limited to, such things as driver error: adverse weather conditions; theft and/or other criminal activity; impaired judgment; physical, mental, and emotional injury; and other risks and dangers whether known or unknown nor reasonably foreseeable.
7. WAIVER OF LIABILITY
KBB shall not be held responsible for any injuries, however caused. Customer hereby releases and fully discharges KBB including its officers, agents, and employees, from any and all claims or causes of action that may be brought by Customer, including all liability for death, personal injury, damage to or loss of personal property which may result from Customer’s participation in the activities described in this Tour Reservation and Agreement whether caused by negligence or otherwise, to the fullest extent permitted by law. Customer further agrees that KBB will not be liable for any losses or expenses due to terrorism, civil unrest, sickness, theft, fire, adverse weather conditions, airline or other travel arrangements.
8. INDEMNIFICATION
Customer agrees to indemnify and hold harmless KBB, its agents, successors, and assigns from and against any and all claims, damages, losses and expenses, including reasonable attorneys’ fees, arising out of or resulting from the death of any person, bodily injury, damage to real or tangible personal property resulting from the negligent or willful acts of Customer.
9. AMENDMENT, MODIFICATION OR WAIVER
Customer agrees that no amendment, waiver or modification of this Tour Reservation and Agreement or of any covenant, condition, or limitation contained in it shall be valid unless it is in writing and duly executed by both parties.
10. SEVERABILITY
If any term or provision of this Tour Reservation and Agreement is invalid, illegal or unenforceable in any jurisdiction, such invalidity, illegality or unenforceability shall not affect any other term or provision of this Tour Reservation and Agreement or invalidate or render unenforceable such term or provision in any other jurisdiction.
11. GOVERNING LAW
Customer agrees that this Tour Reservation and Agreement and performance under it and all suits and special proceedings relating to it will be construed in accordance with, under and pursuant to the laws of the State of Kentucky without giving effect to any choice or conflict of laws provision or rule that would cause the application of laws of any jurisdiction other than those of the State of Kentucky. Each party irrevocably submits to the exclusive jurisdiction of the Spencer County court in connection with any such suit, action or proceeding.
Service of process, summons, notice or other document by email to Customer’s electronic mail address set forth in this Tour Reservation and Agreement shall be sufficient service of process for any suit, action or other proceeding brought in any court, or for any notice as otherwise may be required by law.
12. PHOTO, VIDEO AND AUDIO CONSENT AND RELEASE
Customer authorizes KBB, acting through its agents, employees, or representatives, to take photographs, video recordings, and/or audio recordings of Customer, including his/her name, image, likeness, performance, and/or voice (“Recordings”) during the course of Customer’s participation in the TOUR. Customer also grants KBB an unlimited right to reproduce, use, exhibit, display, perform, broadcast, create derivative works from, and distribute the Recordings in any manner or media now existing or hereafter developed, in perpetuity, throughout the world for any purpose, including but not limited to, marketing, advertising, publicity, or other promotional purposes without compensation to Customer.
13. CANCELLATION POLICY
There is a minimum of 10 Customers required per Public Tour. KBB reserves the right to cancel the Tour if the minimum number of Customers is not met. If the Tour is cancelled, Customer has the option of receiving a full refund or transferring Tour purchase to a different Tour.
Refunds on tour tickets will be given (minus processing fee of 10%) if cancellation is done at least 14 days prior to event. Refunds for private events will be given (minus deposit) if cancellation is done at least 14 days prior to event. No refund can be given if cancellation is done within the 14 day timeframe prior to event. One reschedule is allowed per order if cancelling at least 14 days prior to event.
14. ADDITIONAL FEES
Customer will be charged additional fees as follows for the below acts of negligence:
1. SMOKING: There is a no smoking policy on the bus. Customer will be charged $150 for smoking.
2. CLEANUP: Customer will be charged a minimum of $150 for any extensive cleanup, including vomit.
3. ADDITIONAL ITEMS: As described in Section 5, Customer is responsible for any damages, whether accidental or deliberate. Actual fees for repairs and labor will be charged to Customer depending on damages caused.
RULES FOR TOUR PARTICIPATION
1. Customer hereby consents to KBB agents and employees inspecting any oversized bags that are brought onto the tour bus.
2. Drinking alcohol is not allowed on the bus during guided tours. Drinking alcohol is permitted during private events, however KBB will not provide alcohol to our customers. Customers must be 21 years of age.
3. Tour guide will inform customers at least 15 minutes before departing a facility that the bus will be leaving. If Customer is not on the bus, KBB may leave Customer behind. No refund will be granted.
4. Customer will wear closed toes shoes.
5. Customer will exhibit appropriate behavior both on the bus and at each touring facility.
6. Customer will respect the personal space and personal property of other participants on the TOUR.
7. Customer will remain seated while the bus is moving.
8. Customer will follow requests made by the TOUR operator, his agents or employees.
9. Customer is prohibited from brining potentially injury causing items on to the bus including but not limited to guns/firearms, knives, sticks, breakable containers, and aerosol containers.
10. Customer is prohibited from smoking, lighting matches or using any type of flame or sparking device on the bus or in the touring facility.
11. Customers shall refrain from using vulgar, obscene or offensive language.
12. Customer shall refrain from speaking to, or otherwise engaging in behavior that may distract the bus driver.
13. No animals are permitted on the bus or in any touring facility.
14. No musical devices are permitted on the bus unless they are used with headphones.
15. Customer shall place trash in a proper receptacle.
16. Customer is prohibited from touching the emergency exits unless there is an actual emergency.
17. Customer shall refrain from bringing outside alcohol into any Brewery, Distillery, or Winery on the Tour.
If Customer is in violation of any of these Rules for Participation, KBB reserves the right to remove the Customer from the TOUR without refund, regardless of location.
Customer agrees to the terms of this Winery/Brewery/Distillery Tour and Special Event Reservation Agreement and the RULES FOR TOUR PARTICIPATION.

RESERVATION AGREEMENT
This Winery/Distillery/Brewery Tour and Special Event Reservation Agreement (“Tour Reservation Agreement) is between the user referred to herein as “Customer,” and THE BARREL RUN, LLC, a limited liability company, organized and existing under the laws of the State of Illinois, with its principal office located at 11234 South Bell Avenue, Chicago, IL 60643, referred to herein as “TBR.” Collectively, TBR and Customer shall be referred to herein as the “parties.”
Whereas, TBR owns and operates a winery, distillery and brewery touring and special event chartering business out of its Chicago office; and Whereas, Customer desires to participate in a winery/brewery/distillery tour or rent TBR bus for for a special event and attests that he/she is 21 years of age or older.
Now, therefore, for and in consideration of the mutual covenants contained in this Tour Reservation and Agreement and other good and valuable consideration the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows:

Refund Deadlines with Travel Protection:
Parties of 1–9: Refundable up to 48 hours before departure. Parties of 10+: Refundable up to 1 week before departure.
Standard Policy (No Protection):
Parties of 1–9: Refundable up to 2 weeks before departure. Parties of 10+: Refundable up to 1 month before departure.
Please note: Tickets are only refundable within these stated timeframes. If you miss the standard window, a refund is only possible if you purchased Travel Protection. The cost of Travel Protection itself is non-refundable but may be applied toward a rescheduled booking.
- ADDITIONAL FEES
Customer will be charged additional fees as follows for the below acts of negligence:

Customer agrees to the terms of this Winery/Brewery/Distillery Tour and Special Event Reservation Agreement and the RULES FOR TOUR PARTICIPATION.
